JOINT BASE SAN ANTONIO, Texas –
During the month of June, there was one court-martial of an Air Force member at Joint Base San Antonio.
In the case of U.S. v. Staff Sgt. D.C., 834rd Cyberspace Operation Squadron, JBSA-Lackland, was tried before a special court-martial consisting of officer and enlisted members from June 21-23 at JBSA-Lackland. SSgt D.C. was acquitted of a single charge of wrongful use of marijuana in violation of Article 112a of the Uniform Code of Military Justice.
After sentencing, members can request clemency. In some cases, this can change the outcome of their case and/or sentence to something less severe. Acquittals are final results. During June, Joint Base San Antonio Air Force and Army commanders administered a variety of non-judicial punishment actions under Article 15 of the Uniform Code of Military Justice.
The punishments imposed reflect the commander’s determination of an appropriate punishment after considering the circumstances of the offense and the offender’s record.
A “suspended” punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts six months unless a lesser amount is specified. The following are some of the non-judicial punishment actions that closed out during June.
Wrongful Use of Marijuana: A technical sergeant wrongfully used marijuana. The member received a reduction to staff sergeant, forfeitures of $1,616 pay per month for two months (suspended) and a reprimand.
Larceny: An airman in technical training stole a bracelet from the base exchange. The member received a reduction to airman basic, forfeitures of $799 pay per month for two months (suspended) and a reprimand.
Larceny: An airman first class in technical training stole a pair of earrings from the base exchange. The member received a reduction to airman basic (suspended below airman), forfeitures of $799 pay per month for two months (suspended), 17 days restriction to base and a reprimand.
Indecent Language: An Airman in technical training uttered a racial slur during class. The member re-ceived a reduction to Airman Basic (suspended), forfeitures of $896 pay per month for two months (one month suspended), 15 days extra duty, 30 days restriction to base, and a reprimand.
Absent Without Leave; False Official Statement: A technical sergeant went AWOL when ordered to be at a weeklong training course. When later asked as to her whereabouts, the member lied. The member re-ceived a reduction to staff sergeant, forfeitures of $1,616 pay per month for two months (suspended) and a reprimand.
False Official Statement: An airman in technical training lied about the number of sit-ups completed during a fitness assessment. The member received a reduction to airman basic (suspended), forfeitures of $373 pay and a reprimand.
Abusive Sexual Contact: An airman first class in technical training groped the private parts of a female trainee without her consent. The member received a reduction to airman basic, seven days extra duty, 14 days restriction to base and a reprimand.
Wrongful Use of Marijuana: An airman first class wrongfully used marijuana. The member received a reduction to airman, forfeitures of $800 pay (suspended) and a reprimand.
Failure to Obey Order or Regulation: A private first class, without authority, failed to maintain accountability of his common access card on two occasions. The private first class received extra duty for seven days.
False Official Statement/Dereliction of Duty/ Failure to Obey Order or Regulation: A specialist made a false official statement to a noncommissioned officer. The specialist was derelict in her duties by not answering her phone when called for missions. The specialist also failed to go to her appointed place of duty on two occasions. The specialist received a forfeiture of $205 in pay, extra duty for 14 days and an oral reprimand.
Sexual Assault: A specialist committed a sexual act upon the victim without her consent. The specialist received a reduction to the grade of E-1, a suspended forfeiture of $799 pay per month for two months, extra duty for 45 days, restriction to the limits of the company area, dining facility, medical facility and place of worship for 45 days (suspended) and an oral reprimand.
